1. Agreement to Terms

By accessing or using High Value Web Design's website and services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access our services.

2. Services

High Value Web Design provides the following services:

• Custom website design and development
• Website hosting and maintenance
• Client portal access for project management
• Consultation and support services

3. Pricing and Payment

3.1 Pricing Structure

Our services are offered at the following price points:

• Standard Package: $750 - Includes 5-page custom website, mobile-responsive design, free hosting, SSL certificate, contact forms, SEO optimization, and 1 year of updates
• Enhanced Package: $1,000 - Everything in Standard plus API/CRM integrations, advanced forms, social media feeds, user authentication, and calendar integrations
• Professional Package: $1,500 - Everything in Enhanced plus database services, AI connectors, support widgets, product catalogs, and payment processing

3.2 Payment Terms

• Payment is due upon signing the service agreement
• We offer 3, 6, and 12-month payment plans at 0% interest
• All prices are in US dollars
• Prices are subject to change for new contracts but existing agreements will be honored

3.3 No Monthly Fees

Our one-time payment model includes lifetime hosting at no additional charge. There are no recurring monthly fees for hosting or maintenance unless you specifically request additional services.

4. Project Process

4.1 Timeline

• Standard delivery time is approximately 2 weeks from project start
• Timeline may vary based on project complexity and client responsiveness
• Rush delivery may be available for an additional fee

4.2 Client Responsibilities

To ensure timely project completion, clients must:

• Provide necessary content (text, images, logos) in a timely manner
• Respond to design feedback requests within 48 hours
• Provide clear project requirements and objectives
• Designate a single point of contact for the project

4.3 Revisions

• The project includes reasonable revisions during the design phase
• Major scope changes may incur additional fees
• Revisions must be requested before final approval

5. Ownership and Intellectual Property

5.1 Client Ownership

Upon full payment, the client owns their website completely, including all custom code, design elements, and content created specifically for their project. Clients receive full access to all files and code.

5.2 License for Framework Code

Any pre-existing frameworks, libraries, or reusable code components remain our intellectual property but are licensed to the client for unlimited use in their website.

5.3 Portfolio Rights

We reserve the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.

6. Hosting and Technical Support

6.1 Free Hosting

• Hosting is provided free of charge for the lifetime of your website
• Hosting includes 99.9% uptime guarantee
• SSL certificates are included and automatically renewed
• Reasonable bandwidth and storage limits apply

6.2 Support

• First year includes free content updates and minor changes
• After the first year, updates are available at $50 per request
• Major redesigns or functionality additions are quoted separately
• Emergency support is available during business hours

7. Refund and Cancellation Policy

7.1 Refunds

• Full refund if canceled before design work begins
• 50% refund if canceled after design approval but before development
• No refund after development has begun
• Completed websites are not eligible for refunds

7.2 Cancellation

Either party may cancel the project with written notice. Refunds will be issued according to the refund policy above. Work completed to date remains the property of High Value Web Design until payment is made.

8. Limitation of Liability

To the maximum extent permitted by law, High Value Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the services.

9. Warranties and Disclaimers

9.1 Service Warranty

We warrant that:

• Services will be performed in a professional and workmanlike manner
• Websites will function substantially as designed
• We have the right to provide the services offered

9.2 Disclaimers

Services are provided "as is" without warranty of any kind beyond those expressly stated. We do not guarantee specific business results, search engine rankings, or visitor traffic levels.

10. Indemnification

You agree to indemnify and hold harmless High Value Web Design and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of our services or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of South Carolina, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Charleston County, South Carolina.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of our services after changes become effective constitutes agreement to be bound by the revised terms.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with any signed service agreement, constitute the entire agreement between you and High Value Web Design regarding our services and supersede all prior agreements and understandings.
